This petition is a crucial step in ending age discrimination in the work place and in America and convincing the United States Congress that such legislation is in the best interest of all of the American people and needed immediately  ! 

This petition addresses the core issue, that of age discrimination which drives many serious cyclical age and unemployment bias and unjust hiring practices. 

It is our purpose to end age discrimination in the work place, from companies, employment and, staffing agencies regarding practices such as unemployed bias in job ads, the interview process, unemployed status, bad credit bias and  that toward extending unemployment benefits for those without work for more than six months. 

Federal legislation is needed that would provide age discrimination protection to workers age  forty and older like that  provided for race, gender, national origin and religion in civil rights law.

 It has come to a point where numerical standard mandated by Federal law is justified and legislation establishing such is put into law. 

Such a law would mandate companies with 40 or more  employees  implement numerical, documented verification standards requiring that a set number (1 in 5) employees in their work force is comprised of individuals between the age of forty and sixty five years of age. 

Special tax credits will be allowed to all companies who hire an individual who has been unemployed six months or more without prejudice to credit ratings or unemployment status.

 The “2011 Fair Playing Field Act to protect All American Workers Against Age discrimination” Federal legislation establishing numerical standards mandated by Federal law is good for America , its workers, the economy, substantially decreases unemployment benefit costs and provides a fairer playing field for American workers throughout the duration of their work life-careers. 

It restores jobs, dignity, human and civil equality and justice, liberty and affords Americans the  right and opportunity to work, provide for their families and to pursue the American dream.

    This is far more common question than one might think!!
    The fact a recruiter would even ask a candidate that question pretty much says it all.

    Obviously this is just one of those lose-lose questions for a candidate. It’s damned if you do or don’t, either way.

    If candidates become offended & don’t respond in a positive manner; their resume goes into the circular file.

    Unless the conversation is recorded, it’s a he said-she said!
    And even if it recorded & taken to an attorney- now with the 2009 supreme court ruling , you can be assured that an attorney will not take an age discrimination suit on a contingency any more. Age discrimination cases are next to impossible to win since 2009.

    Recruiters are paid to give the companies what they ask for. They are the buffers for big companies & both of them protect each other. This has been going on for the 27 years that I have been a national recruiting professional. Clearly the trickle down is killing our older workers.
    The only thing that stood between older workers & age discrimination since 1967 was the law & thanks to Clarence Thomas & big business lobbies, older workers have lost that protection .

    50+ people need to unite on this. Furthermore, petition could be amended to require employers to offer on-the-job training.

    The job crisis needs to address: What happens if you are over 40 and lose your job?
    Companies now drop middle-aged, faithful employees in favor
    of 20 somethings…so they can pay them less.
    There are lots of highly skilled, very educated and experienced middle-aged people who are now without a paycheck.
    This is so unfair, and must end.

    When I became a Sr. over 55 and my “Grey” became more obvious, my first thoughts were to get rid of it. Then I realized it was God’s way of letting folk know I had earned my wings in wisdom and love. Now, as I grow even older and see even more grey, I thank God for allowing me to become wiser every day.

    As a retired Sr. Analyst from ComEd who had to fight and struggle just to make it to mid-management, I appreciate the 2011 Fair Playing Field Act that will protect my children and others in the work place from discrimination as they growing older giving them better opportunities than we had under less caring administrations. President Obama has already made great strides in eliminating discrimination from the work force with the first bill he signed giving equal pay for equal work to women.     I signed the petition, although I take issue with this bill’s proposed quota system, which will never get sufficient support in Congress to pass. Hoe do I know? I was a lobbyist representing businesses in the 1980’s the author refers to. I have a resume with no specific dates of employment listed and when I recently used it to apply for 3 specific positions. I got interviews almost immediately. However, after my interviewers figured out my approximate age, I was clearly out of the running. I even got a phone call from a member of a search committee asking for a date specific revised resume. I complied with the request, leaving out everything before 1985, and haven’t heard a word since. Our society really needs an attitude adjustment before all of us Baby Boomers end up homeless, but you won’t get there with a federally mandated employment quota. I’m not a lawyer, but I did represent employers during Congressional passage of the last Civil Rights employment bill in the early 90’s, and changing the criteria under which a plaintiff could bring a prima facie case was a major element of the legislation. Since, as you indicate in your blog, the statute has been completely watered down judicially, can’t it simply be re-enacted in it’s purer form?

    If you’d like some free advice on strategy and tactics, I’d be happy to provide it off-line. Your cause is brilliant and there is no one who does not believe that older workers need protection. I just hope you are serious about it enough to get the mission accomplished properly.
