HOW MUCH ARE AMERICAN’S WILLING TO GIVE UP??

  • Jobless, long term unemployed, no unemployment benefits , jobs- health care- savings-homes-dignity-financial future- gone . Thrust into poverty &  a living night mare ! This will not end-until we end it!                                      
  • The same politicians that voted to end social security-medicare-school lunches-medicade- stop public education also collaborated on the passing of this bill  (Surprised?)  ADEA  ( Gross v. F.B.L. Financial Services ) http://www.dickinsonlaw.com/docs/publications/290.pdf 
  • Jack worked for nearly a quarter century as a claims adjuster for FBL Financial in West Des Moines. He was a model employee, with performance reviews in the top three percent of the company for 13 consecutive years. Then, in 2003, when he was 55 years old, his company brazenly demoted him and other employees over the age of 50. His job was give to a much younger, less qualified person.      
  • No longer being protected by Civil Rights Law has far more ramifications than workers initially realized and especially in declining economic times.
  • Bullying – Harassment   The fear of loosing jobs and the financial issues to follow can open the door to un-relentless bullying – harassment and no legal recourse for employees.
  • The “Right to Work” ruling that many states pride themselves with having, actually mean totally the opposite than it sounds) It really means a company can fire an employee for any reason-any time-with no recourse). Leaving a company free to bully-harass older workers or anyone they choose.

WEAR A SPEEDO’ or GET FIRED?!

WOULD YOU WEAR A SPEEDO TO SAVE YOUR JOB ? This 50+er lifeguard FIRED after 40 years on job (+ 8 others) by New York State Parks after refusing to wear a Speedo-style swim briefs & lost the case in supreme court due to U.S Supreme Court’s 2009 decision that stripped away civil rights protections (Gross v. FBL Financial) leaving older workers with no civil rights protection in the work place and no recourse.

Immeasurable value provided only by older workers . Human resources managers across the country agree and attest to the advantages of employing highly committed older workers. In surveys of 500 + companies with 50 or more employees, HR managers identified invaluable qualities only present in experienced-mature workers

  • Punctuality – reliability tend to be a given for older workers who regularly arrive on time ready to work and take little or no time off.
     
  • Pride in a job well done is an increasingly rare commodity among to day’s employees. Mature workers tend to be more willing to stay until the job is done because of their sense of pride in the quality of the finished product.

  • In a ruling of the 2009 Supreme Court decision in the case of Gross vs. F.B.L. Financial Services rights were stripped away from older workers making it very difficult for workers to prove that age discrimination did in fact occur in the work place. 
  • The court’s ruling specifically means that victims of age discrimination face a much higher legal burden of proof than those alleging race, sex, national origin or religious discrimination.
  • Silence is consent; doing nothing leaves older Workers –Seniors at risk while law makers still chip away at their Civil Rights!
  • Violation of Your Civil Rights  This ruling treats older workers + seniors like second class citizen & is a major set back – putting age discrimination back to 1950’s laws.
  • This is a wake up call to anyone who plans to live past 50 ; stay silent -do nothing - and there go all of our civil rights .

Will age discrimination be an issue for you during your career ?

Age discrimination is the most underreported problem in employment, and crosses all gender, social, generational, economic, political, disability and religious lines. Boomers alone represent 73 million voters. Add to that those of us who want to keep our good jobs after age 50 or older and we have a POWERFUL VOICE for change.

Aren’t we the same people who brought about trememdous changes in the 60’s-70’s and 80’s ? So now are we going to be silent like lambs led to the slaughter, until they come for us too?

TOGETHER, WE CAN DO THIS. THIS is the TIME to get MAD as HELL and FIGHT for CHANGE. YES , WE CAN !!

 Age discrimination crosses all boundaries – gender, race, cultural, political, and economic.

It undermines our fundamental civil rights, moral -core values, and the financial security of Americans as they age.

 This  is a public forum where ageism issues are brought into the spot light to be seen globally by world leaders, Americans, the media, & public officials? Where is the humanity for older workers?

 Many workers associate their identity and self worth with their jobs. Often after long term unemployment workers become humiliated, demoralized, demobilized and in a state of hopelessness. No longer a threat to the greedy executives that kicked them to the curb; many will become homeless or commit suicide.

Is this the legacy we want to leave our children, grand children and ourselves???

 Ending age discrimination in the work place has to be the one issue that “everyone with a conscious will agree on.”

We can no longer sit back like lambs to the slaughter; no matter where you are, what group, organization, coalition, association, political or religious preference; we all know this is wrong.

 Thank you for having the courage and back bone to stand up and tell your stories.

You may have saved a life or motivated another American worker to have the strength and determination to fight back, stand together and vote to change what corporate America is allowed to do to our workers as they age.
